Father’s Motion for Child Support Modification Denied, Sanctions Ordered

The May 2019 edition of Divorce Digest reports on a Cook County case decided by Associate Judge Mary S. Trew where Rachel Johnson of Birnbaum, Haddon, Gelfman & Arnoux, LLC represented an ex-wife and mother who moved for summary judgment with regard to the father’s Amended Motion for Modification. The father sought reduced child support based on a claim that he had lost his job.

Judge Trew granted the mother’s summary judgment motion and ordered monetary sanctions against the father in the amount of $10,894.00 — the fees incurred by the mother for Birnbaum, Haddon, Gelfman & Arnoux to defend her in the matter.

The court ordered the sanctions after determining that the father’s pleadings falsely and knowingly claimed he had lost his job. In fact, subpoenaed information showed he had resigned from his position.
